The more money you can get in the form of a deposit from a potential
buyer the greater the chance of getting to a closing. The more a buyer has to lose the more
motivated the buyer becomes to buying your home.
Agreement to Purchase
Don’t wait until you have a buyer, get an acceptable Agreement to
Purchase now. You can purchase forms
from an office supply such as Office Depot, Staples, etc. You should also get forms related to Counter
Offers, Deposits, etc. as well.
Seller Disclosures
Louisiana requires that ALL transfers of residential real estate use the
Seller Disclosure form created by the Louisiana Real Estate Commission. This
form is used to identify all known defects and any history on the property
being sold. You can obtain a copy of
this form from any licensed real estate agent.
Contingency Offers; pros and cons
Contingency simply means something has to
happen for something else can happen.
Example, the Agreement to Purchase is “contingent” upon the buyer
obtaining a satisfactory home inspection by a certain date. If the date passes without the inspection, it
is presumed to have occurred. The
problem is that the more contingencies the more likely the sale will fall
through. If a buyer must sell an
existing property before the buyer can buy your property, they so declare on
the Agreement to Purchase. Sellers
should always reserve the right to continue to show and even sell the property
subject to the removal of the contingency of the buyer. This is a confusing issue and you are
strongly encouraged to talk this over with a real estate professional before
entering into a contingency of sale.
Buyers may avoid looking at your property if they know there is a
pending contract contingent upon the sale of another property.
